Competition – modernisation reform


The EEA Joint Committee took a decision incorporating Council Regulation 1/2003, the modernisation regulation, into the EEA Agreement. The modernisation reform relates to the prohibition of agreements in restraint of competition (article 53 EEA) and the abuse of a dominant market position (article 54 EEA).

07/12/2004 :: The new regime ensures a more effective enforcement of competition rules, with a closer involvement of national courts and competition authorities in the application of the rules. Agreements between undertakings can no longer be notified to the EFTA Surveillance Authority in order to benefit from an exemption. Instead undertakings must themselves ensure that their agreements are in conformity with the competition rules.
